Cool Cloud Vapor had marketed its e-liquid product as a supplement and a sports drink. These statements were misleading, the FDA says, because no FDA regulatory criteria or laws exist to modify health supplements and sports drinks. The business’s application for a non-prescription marketplace distribution label especially stated that the product could possibly be used as a dietary supplement.
